Why are my fingerprints or a background check being requested?

2. Education Verification: This report verifies the schools or colleges an applicant attended, dates of attendance, and any degrees or diplomas earned.
3. Criminal History: A criminal background check reveals non-expunged criminal convictions, including the type of offense, offense date, level of offense (misdemeanor or felony), disposition of the offense, date of disposition, and sentence information.
4. Identity Verification: This check ensures that the applicant's provided information, such as Social Security number, birthdate, and name, matches their identity. It also verifies former names used and associated addresses.
5. National Sex Offender Registry Check: Requesting this check helps identify if an applicant is a registered sex offender in any U.S. state, providing relevant information about the underlying conviction.

1. Fair Credit Reporting Act (FCRA): This federal law protects consumer privacy when information is collected, held, and shared by consumer reporting agencies. Employers must provide written disclosure and obtain the applicant's permission before conducting background checks. Adverse action procedures should be followed if negative information influences the hiring decision.
2. Title VII of the Civil Rights Act: This federal anti-discrimination law prohibits workplace discrimination based on protected characteristics. Employers should assess individual criminal convictions in relation to the job position.
In addition to federal laws, Missouri has specific regulations, including:
1. Missouri Executive Order 16-04: This ban-the-box law prohibits questions about criminal history on applications within the executive branch of the Missouri state government. However, certain exceptions apply based on eligibility for the position.
2. Kansas City Ban-the-Box Ordinance: Employers with six or more employees must postpone inquiries about criminal history until the applicant is determined otherwise qualified for the job and has had an interview. Convictions should only be considered if directly related to job requirements.
